Terms of Service

1. Acceptance of Terms

By accessing or using SellerCard (the “Service”), you agree to be bound by these Terms of Service (“Terms”) and our Privacy Policy. If you do not agree, you must not use the Service.

2. Description of Service

SellerCard is a credit-based Software-as-a-Service platform that uses artificial intelligence to help e-commerce sellers generate product photos, product cards, listings, and short product videos for marketplaces such as Amazon, Etsy, eBay, Shopify, Walmart, and comparable platforms.

Users purchase access to the Service through star packs. The Service is provided entirely in digital form and does not involve the sale or shipment of any physical goods.

SellerCard does not operate as a marketplace, reseller, intermediary, or payment processor for transactions between you and third parties.

AI Disclosure

All image, video, and text content generated through the Service is produced using artificial intelligence. Generated content may contain inaccuracies, unintended artifacts, or may resemble other works. You are solely responsible for reviewing, editing, and verifying all generated content before using it in commerce or publishing it to any platform.

Outputs carry machine-readable AI-provenance metadata (including C2PA signals where provided by the underlying model). You agree not to remove, alter, or otherwise circumvent this metadata. Doing so may also violate third-party terms of service (including OpenAI's Usage Policies) and applicable law (including Art. 50 of the EU AI Act, once in force).

3. Eligibility & Age Requirements

  • You must be at least 16 years old to use the Service if you are located in the European Economic Area or the United Kingdom.
  • You must be at least 13 years old if located in the United States; users under 18 must have parental or guardian consent.
  • You must be at least 14 years old if located in Bulgaria (our place of establishment), per BG Personal Data Protection Act.
  • If you are using the Service on behalf of an organization, you represent that you are authorized to bind that organization to these Terms.

4. Account Registration

  • Provide accurate and current information when creating an account.
  • You are responsible for maintaining the confidentiality of your credentials.
  • One person may not maintain more than one free account or use technical means to obtain multiple free trials or bonuses.
  • You must notify us promptly if you suspect unauthorized use of your account.

5. Credits, Pricing, and Payment

Access to the Service

Access is granted through credits (“stars”). Purchasing stars grants you a limited, non-exclusive, non-transferable, revocable license to use the Service for the stars you hold.

Subscription Plans

SellerCard offers monthly subscription plans that grant a fixed allowance of stars (“subscription credits”) at the start of each billing period. Plans auto-renew at the price and interval shown at checkout until you cancel. You can cancel at any time from your Billing page or through the Polar customer portal.

Current subscription plans:

  • Starter: $9/month or $84/year — 10 listings per month
  • Growth: $18/month or $172/year — 30 listings per month
  • Pro: $49/month or $470/year — 100 listings per month

Credit reset and rollover. Subscription credits are issued at the start of each billing period. Unused subscription credits from the previous period carry over for one additional month (1-month rollover grace) up to a cap of twice the plan's monthly allowance — beyond that, excess is forfeited. Bonus credits (signup bonus, referral, Telegram subscribe) and one-time pack credits never expire and are not affected by the subscription reset.

Auto-renewal. Your subscription renews automatically at the end of each billing period using your stored payment method. You will receive a renewal reminder approximately three days before each charge. If a payment fails, our payment provider retries the charge over a 7-day grace period and notifies you by email; if all retries fail, the subscription is canceled and access to subscription credits ends.

iOS App Store Subscriptions

Subscriptions purchased through the SellerCard iOS app are billed by Apple, not by SellerCard or Polar. Payment is charged to your Apple ID at the confirmation of purchase. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period. You can manage and cancel iOS subscriptions in iPhone Settings → Apple ID → Subscriptions → SellerCard.

Cross-platform billing. iOS App Store subscriptions and sellercards.com web subscriptions are billed separately, by different providers (Apple and Polar respectively), and are tracked as independent accounts with independent credit balances. A web account and an iOS account using the same email address are not automatically linked. To benefit from a single tier across both platforms, choose the platform that suits you and use it consistently. We may add cross-platform identity bridging in a future release.

One-Time Credit Packs

In addition to subscriptions, you can purchase one-time star packs that do not expire. Purchased pack credits and bonus credits stay on your account forever and are spent only after subscription credits in any given billing period are exhausted.

Current one-time packs:

  • Free trial (signup bonus): 3 free stars granted on account creation.
  • Starter: $910 stars ($0.90 per star)
  • Growth: $1830 stars ($0.60 per star)
  • Pro: $49100 stars ($0.49 per star)

Per-action cost in stars:

  • Photo generation: 1 star(s)
  • Product card: 1 star(s)
  • Listing text: 1 star(s)
  • Video generation: 2 star(s) (registered accounts only)
  • Background removal / enhancement / try-on: 1 star each

Prices are in USD and exclude applicable taxes. EU customers may be subject to VAT based on their country of residence, which will be shown at checkout. SellerCard reserves the right to modify pricing with 30 days' notice to existing users. Purchases are processed by our payment provider, Polar Software Inc. (USA). Payments made before 2026-04-28 may have been processed via our previous provider, Revolut Merchant; historical orders and refund requests for those payments remain valid and are handled by SellerCard support.

EU Withdrawal Right for Digital Content (Directive 2011/83/EU)

Normally, consumers residing in the European Union have a 14-day right to withdraw from a contract for digital content. By purchasing a star pack or subscribing to a paid plan and beginning to use the Service, you expressly consent to immediate performance of the contract and acknowledge that you lose your 14-day right of withdrawal as soon as any star is spent on a generation (Art. 16(m) Directive 2011/83/EU).

For one-time packs you may still request a refund of unspent stars within 14 days of purchase as set out below. For subscriptions, the cancel-anytime prorated-refund policy described below applies in lieu of the 14-day waiver.

Refund Policy

Subscription refunds. If you cancel a monthly or annual subscription, we refund the unused portion of the current billing period on a prorated basis (calculated by Polar based on the days remaining in the period). Subscription credits that have already been consumed during the period are not refundable. For example: if you cancel on day 10 of a 30-day monthly cycle, you receive approximately a 2/3 refund of that month's charge. Annual subscriptions are prorated by remaining whole months in the same way. Refunds are issued automatically by our payment provider to the original payment method; no support ticket is required.

iOS subscription refunds. Subscriptions purchased through the iOS App Store are refundable only by Apple. To request a refund, open the App Store → tap your profile → Purchase History → tap the SellerCard charge → Report a Problem, or visit reportaproblem.apple.com. SellerCard cannot directly issue refunds for iOS-billed subscriptions but will recognise Apple-issued refunds within 24 hours of the refund webhook from the App Store.

One-time pack refunds. Unspent stars from a purchased pack may be refunded within 14 days of purchase for EU consumers, or within 7 days for non-EU customers. Used stars are non-refundable. Bonus stars (signup bonus, referral, Telegram subscribe) are non-refundable in any case. To request a pack refund, contact support@sellercards.com with your order ID.

Failed generations. Where a generation fails for technical reasons (model timeout, safety-filter block, server error), we automatically refund the stars consumed. You are not required to contact support for automatic refunds.

6. Acceptable Use

You agree not to use the Service to:

  • Generate illegal, misleading, or deceptive product listings or content.
  • Violate applicable advertising, consumer protection, or marketing laws (including EU Regulation 1924/2006 on nutrition and health claims, US FTC Act §5, FDA regulations where applicable, and comparable local laws).
  • Violate the terms of service or listing policies of Amazon, Etsy, eBay, Shopify, Walmart, or any other marketplace on which you list generated content. In particular, you will comply with those platforms' AI-content disclosure rules.
  • Create false or unverified medical, health, therapeutic, or efficacy claims about any product (including terms such as “cures”, “treats”, “FDA approved”, “clinically proven” where not substantiated).
  • Generate, request, or publish a likeness of any identifiable real person (including public figures, celebrities, politicians, athletes, or private individuals) without that person's prior written consent.
  • Generate sexual, sexualized, or otherwise inappropriate content involving minors, or content that could reasonably be mistaken for such. You represent and warrant that any photo you upload does not depict a person under 18 without the verifiable consent of that person's parent or legal guardian.
  • Generate deepfakes, non-consensual intimate imagery, hate speech, terrorist content, or content that promotes violence, self-harm, or discrimination against any protected class.
  • Use the Service to produce counterfeit, trademark-infringing, or brand-impersonating product listings.
  • Reverse-engineer, scrape, stress-test, or otherwise disrupt the Service or its underlying providers (OpenAI, Supabase, and others listed on our Subprocessors page).
  • Circumvent credit-deduction, rate-limits, free-trial limits, watermarking, AI-provenance metadata, or any other usage control.
  • Build a competing service using the Service's outputs or its interface.
  • Share your account credentials or transfer stars to a third party for consideration.

We may remove generated content, suspend, or terminate your account if we reasonably suspect a violation of these rules.

7. Your Content and AI Outputs

Uploaded Content — Your Warranty

You retain ownership of the photos, text, and other materials you upload (“User Content”). By uploading User Content, you represent and warrant that:

  • You own the User Content, or you have obtained all necessary licenses, permissions, and releases to use it with the Service.
  • The User Content does not infringe the intellectual property, publicity, or privacy rights of any third party.
  • If the User Content depicts an identifiable person, you have that person's written consent; if the person is a minor, you have the consent of their parent or legal guardian.
  • The User Content does not contain confidential or trade-secret information of any third party.

License to Process

You grant SellerCard a worldwide, royalty-free, non-exclusive license to store, transmit, and process your User Content solely for the purpose of providing the Service to you, including sending your inputs to our AI subprocessors (e.g., OpenAI) for generation. We do not use your User Content to train public AI models.

Generated Outputs

Subject to these Terms and the usage policies of our AI subprocessors, you own the outputs generated for you through the Service (“Outputs”). Outputs may contain AI-provenance metadata as described in Section 2. You are responsible for ensuring Outputs comply with applicable law and marketplace rules before publication.

Because AI models are probabilistic, different users may occasionally receive similar Outputs. We make no guarantee of uniqueness.

8. Watermarks and Free-Tier Previews

Previews and downloads available to unregistered users may carry a visible SellerCard watermark. Paid and registered users receive clean downloads from the same generated file (no re-generation required). You agree not to remove or obscure watermarks from content you are not entitled to receive clean.

9. Competitor & Research Tools

Our research tools may fetch publicly available data from third-party websites on your direct request. You are responsible for ensuring your use of such data complies with the target website's terms and applicable law (including the EU Directive on Copyright in the Digital Single Market where relevant).

10. Intellectual Property of the Service

All rights to the platform itself — including software, design, trademarks, logos, AI-pipeline integrations, and brand elements — remain with SellerCard / CREATIVESERVICE EOOD. No rights are granted to you other than the limited right to use the Service in accordance with these Terms.

11. DMCA / Copyright & Takedown

If you believe content generated or published through the Service infringes your copyright, publicity rights, or trademark, send a notice to abuse@sellercards.com including:

  • Your contact information and, if you are a rights holder, proof of that status.
  • Identification of the protected work and the allegedly infringing content.
  • A good-faith statement that the use is not authorized, and a statement under penalty of perjury that the information is accurate.
  • A physical or electronic signature.

We respond to valid notices within a reasonable time and may remove or disable the identified content and, where appropriate, suspend the responsible account.

EU Digital Services Act — notice and action. In addition to the copyright-specific procedure above, users and non-users may report any illegal content (including IP infringement, illegal hate speech, defamatory material, or CSAM) through our dedicated notice-and-action mechanism at /legal/report-abuse. Submissions that meet the DSA Art. 16(2) elements are acknowledged within 48 hours. Users affected by a moderation decision may challenge it by emailing privacy@sellercards.com and may also refer the dispute to a certified out-of-court dispute settlement body per DSA Art. 21.

12. Limitation of Liability

To the fullest extent permitted by law, SellerCard and CREATIVESERVICE EOOD shall not be liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, data, goodwill, or marketplace account standing, arising out of or in connection with your use of the Service.

Our total aggregate liability for any claims arising out of or related to the Service is limited to the greater of (a) the amount you paid for the Service in the 12 months preceding the event giving rise to the claim, or (b) EUR 50.

This Section does not limit liability that cannot be excluded under applicable law, including for gross negligence, willful misconduct, personal injury, or mandatory consumer protection rights.

13. Indemnification

You agree to defend, indemnify, and hold harmless SellerCard and CREATIVESERVICE EOOD from any third-party claim, demand, or expense (including reasonable legal fees) arising out of: (a) your breach of these Terms; (b) your User Content or the use of Outputs you published; (c) your violation of any law or third-party right; or (d) your violation of any marketplace's rules.

14. Privacy

Use of the Service is subject to our Privacy Policy. A current list of third-party processors that handle your data is available on our Subprocessors page.

15. Termination

We may suspend or terminate your account at any time for material breach of these Terms, fraud, or where we are legally required to do so. You may close your account at any time from your account settings or by contacting support. On termination, any unspent purchased pack stars may be refunded in accordance with Section 5; bonus stars are forfeited; any active subscription is canceled and the unused portion of the current billing period is refunded on a prorated basis in accordance with Section 5.

16. Service Availability

The Service is provided on an “as-is” and “as-available” basis. We strive to maintain high availability but do not guarantee uninterrupted access. We may modify, suspend, or discontinue features with reasonable notice where commercially possible.

17. Governing Law & Disputes

These Terms are governed by the laws of the Republic of Bulgaria, without regard to conflict-of-law principles. EU consumers retain all statutory rights, including the right to bring proceedings in the courts of their country of residence.

The European Commission provides an online dispute resolution platform at https://ec.europa.eu/consumers/odr.

18. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated to registered users by email at least 14 days before they take effect, and will be reflected by an updated “Last updated” date at the top of this page. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.
